Ken Kyre last week obtained from the Guildford County Superior Court a dismissal of a lawsuit against four of his clients, including an apartment complex serving seniors. He successfully argued that, under Rule 12(b)(6) of the N.C. Rules of Civil Procedure, the plaintiff had not sufficiently stated claims that met the requirements for a proper pleading. The Court dismissed the claims with prejudice, meaning the claims cannot be brought again.
